1. Acceptance of Terms

3. Intellectual Property Rights

4.2 Limitation of Damages
To the fullest extent permitted by Canadian law, CreativeMetric shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of use, or business interruption, even if we have been advised of the possibility of such damages. This limitation applies regardless of the legal theory on which such damages are claimed (contract, tort, negligence, or otherwise).
4.3 Cap on Liability
In no event shall CreativeMetric's total liability to you for any and all claims arising from or relating to your use of the Site exceed the amount of $100 CAD.
4.4 Exceptions
The limitations of liability in this section do not apply to: (a) gross negligence or willful misconduct; (b) personal injury or property damage; (c) fraudulent misrepresentation; or (d) liabilities that cannot be excluded or limited under applicable law.

The Site may contain links to third-party websites, resources, and services. CreativeMetric does not control, endorse, or assume responsibility for the content, accuracy, or practices of third-party sites. Your use of third-party sites is at your own risk and governed by their terms of service and privacy policies. 6. User Conduct

8. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Prince Edward Island, Canada, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Prince Edward Island for the resolution of any disputes arising from or relating to these Terms or your use of the Site.
9. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
10. Entire Agreement
These Terms, together with our Privacy Policy and any other policies posted on the Site, constitute the entire agreement between you and CreativeMetric regarding the use of the Site and supersede all prior and contemporaneous agreements, understandings, and communications, whether written or oral.
11. Waiver
The failure of CreativeMetric to enforce any right or provision of these Terms does not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of CreativeMetric.
